New Delhi: The Supreme Court said on Monday it was holding the order to decide in future on the issues of polygamy and ‘hallalah nikah’ among Muslims because the Center has emphasized the deliberations on these aspects.
The observation was made when Attorney General Mukul Rohatgi, appearing at the Center, said that the issues of polygamy and “nikah hallalah” were also part of the court order of two judges had referred to the constitutional court Three issues, including the practice of Triple Talaq among Muslims.
“The scope of the reference had all three issues that concern divorce, hallalah nikah, polygamy.” The three questions refer to this court by the referral decision of the two-judge panel, “said Rohatgi.
A bank incorporating five judges led by Chief Justice J S Khehar said: “It may not be possible to address the three issues in the limited time we have. We continue to hang for the future.”
“If the Supreme Court completely crosses the triple Talaq, we will pass legislation,” he told Rohatgi Monday 5th court cut of the Constitution of the apex court.
The assertion of the Center assumes importance in the context of the observations of the apex Tribunal that will only deal with the question of Triple Talaq as if it were fundamental to Islam.
The AG asked the court to also compose judges Kurian Joseph, RF Nariman, UU Lalit Abdul Nazeer and to clarify the issues of polygamy and “nikah Halala” remain open and will be handled by another court the future.
“It will be dealt with in the future,” the court said. The bank heard a series of petitions challenging the practice of the Triple Talaq among Muslims.
